1. Introduction

CLA Madagascar ("we") cares deeply about protecting your personal data. This Privacy Policy describes, as precisely as possible, the data we actually collect when you use the CLA Madagascar website (the "Site"), why we collect it, how it is processed and protected, and what your rights are.

2. Data We Collect

Placing an order on the Site does not require creating an account. Depending on the contact method you choose to finalize your order, we collect:

  • If you order via WhatsApp: your phone number (country code and number), so we can reach you on WhatsApp;
  • If you don't have WhatsApp: the alternative contact method you choose yourself — your Instagram profile link, your Facebook profile link, a phone number, or an email address;
  • The contents of your cart at the time of ordering: the items chosen, their sizes, colors, quantities and prices.

The Site never asks for your name or postal address, and does not create any user account. Information needed for delivery (address, practical details) and payment arrangements are discussed directly with our team, after your order is submitted, through the contact method you chose — this information is never entered into or stored on the Site itself.

The Site does not offer any online payment: we never ask for or collect any banking information (card number or otherwise). Payment for your order is arranged directly with our team, after the order is sent, through the contact method chosen.

3. Temporary Reservation of Your Items

When you add an item to your cart, the Site assigns your browser a randomly generated technical identifier, unrelated to your identity, to temporarily reserve the corresponding stock — particularly useful for one-of-a-kind pieces, so that two visitors cannot unknowingly order the same item at the same time. This reservation, along with its associated identifier, is automatically deleted from our servers after 10 minutes if the order is not completed, or as soon as the order is submitted.

4. Information Stored in Your Browser

The Site stores a few pieces of information directly in your browser's memory ("local storage"), solely for it to work properly:

  • the contents of your cart, so you can find it again if you return to the Site;
  • the identifier and timestamp related to the temporary stock reservation described in point 3;
  • your chosen language (French or English);
  • whether you have already seen the message informing you about the 10-minute time limit, so it is not shown to you again.

This information stays on your device and is not sent to our servers, except for the reservation identifier mentioned in point 3. The Site does not use any tracking or advertising cookies, and no audience-measurement tool (such as Google Analytics) is currently installed.

5. Verification of Your Alternative Contact Method

If you choose to leave us an Instagram or Facebook profile as your contact method, we run an automatic, best-effort check to make sure the link you provided corresponds to an existing profile: our server directly queries Instagram or Facebook with that link. This check is never 100% guaranteed — Instagram and Facebook intentionally limit this kind of automated request — and it never blocks your order from being sent: if the result is inconclusive, your order is processed normally.

6. Purposes of Processing

The data above is used to:

  • process your order and contact you to finalize delivery and payment;
  • prevent the same item, especially a one-of-a-kind piece, from being sold twice by mistake;
  • respond to requests you send us directly by email, WhatsApp or social media, outside the Site;
  • keep a record of our orders for business and accounting purposes.

7. Legal Basis

The processing of your data is based on the pre-contractual and contractual steps related to your order, as well as our legitimate interest in keeping the Site running properly, securely and reliably — in particular the temporary stock reservation and contact-method verification described above.

8. Data Sharing

Your data is never sold, rented, or shared with third parties for commercial purposes. Internally, only team members responsible for processing orders have access to it, through a secured login.

Two technical exceptions exist: if you choose Instagram or Facebook as your contact method, the link to your profile is sent directly to Instagram's or Facebook's servers (Meta Platforms, Inc.) as part of the verification described in point 5. And if you then exchange messages with us over WhatsApp, email or social media, those exchanges take place on those third-party services, outside the Site, and are governed by their own terms and privacy policies.

The Site does not use any online payment provider or integrated delivery service: as noted above, these aspects are handled directly with our team after your order.

9. Cookies

The Site does not use any tracking, audience-measurement, or advertising cookies. The only information kept on the browser side is what is described in point 4, stored locally on your device rather than through cookies in the strict sense.

10. Retention Period

Orders (items, contact method, amount) are kept in our management system for as long as necessary for the business relationship and applicable accounting obligations. Temporary stock reservations, on the other hand, are automatically deleted after 10 minutes or as soon as the order is completed, as described in point 3. Information stored in your browser stays there until you clear your browser data.

11. Your Rights

In accordance with Malagasy law n° 2014-038 of January 9, 2015 on the protection of personal data, you have the right to access, rectify and delete your data. To exercise this right, simply contact us using the details below.

12. Security

We implement reasonable technical and organizational measures to protect your data against loss, unauthorized access or disclosure. However, no method of transmission or storage is completely secure, so we cannot guarantee absolute security.

13. Changes to This Policy

This Privacy Policy may be updated at any time, in particular to reflect changes to the Site's features or to applicable regulations. The date of the last update appears at the top of this page.
